why the green party’s definition of transphobia is illegal

As the 1600 members-strong Green Party Women’s Declaration has formally commenced legal proceedings against the Green Party of England and Wales (GPEW) for discrimination under the Equality Act 2010, newly recruited members may wish to take a closer look at the internal document which is central to their claim.

How the ‘Guidance to Identify Queerphobia’ adopted by a show of hands by elected representatives serving on the Green Party Regional Council (GPRC) in 2023 ended up as part of the GPEW’s Code of Conduct should in itself have raised major concerns.This is because whilst it took three years of debate for Conference to finally agree to a definition of anti-semitism – Green activists used to take such matters seriously – this ‘Guidance’ was quietly added as an Appendix to the Code of conduct and the Disciplinary process without any debate, nor approval by Conference.

In a leaked 53-pages internal dossier produced by the Party’s own lawyers, the ‘Guidance’ was flagged as carrying a serious risk that it unlawfully discriminated against members with gender-critical beliefs. This ought to have been a warning to the Party’s Executive that to continue suspending or expelling members because of their view that sex is biologial and not to be confused with gender was against the Equality Act of 2010 and as confirmed by the Supreme Court in April 2025.

But focussing on GWD’s legal case and their members’ claim of discrimination because of their Protected gender critical beliefs, here is a selection of clauses from the ‘Guidance’ which The Green Light team have reasons to believe have been used – and continue to be used – by LGBTIQA+ greens serving on the Disciplinary Committee and GPRC – to justify demoting, suspending and expelling large numbers of members with the full knowledge that such sanctions were discriminatory.

Transphobia refers to bigotry, prejudice and discrimination that is experienced by trans(transgender) and gender-diverse people, or people who are perceived to be trans or gender- diverse.

1.Using a label that suggests there is a difference between a trans person’s gender and a cis
person’s gender, for example: “super straight” or “super gay” – terms used for people who
identify as straight/gay, but do not find themselves attracted to trans people of the
opposite/same gende

2. Defining a label to disrespect or disregard another person’s autonomy, for example, trying to
use the word lesbian to only refer to cis women who are attracted to cis women, excluding
trans women on the wrongful belief that trans women aren’t “real women
”.

3. Claiming, implying or insinuating that LGBTIQA+ people are inherently a danger in
bathrooms, changing/locker rooms, prisons, or any other place


4. Claiming, implying or insinuating that there is a conflict between the human rights of the
LGBTIQA+ community (or any part of it) and those of any other marginalised group.

5. Saying that an LGBTIQA+ person of any age is confused, in a phase, following a trend (social
contagion),
or being LGBTIQA+ for attention;

6. Claiming, implying or insinuating that an LGBTIQA+ child or adolescent cannot understand or
be aware of their own identity and/or knowledge of themselves or are too young to know
better

7. Claiming, implying or insinuating that it is right or necessary to forcibly ‘out’ LGBTIQA+ children, adolescents and/or adults to their parents/guardians/family members, with or without the person’s knowledge, or to refer to such a harmful act as ‘safeguarding.’


8. Claiming, implying or insinuating that trans people, because they are trans, should be
separated from the rest of society, required to use segregated facilities, or denied access to
facilities which would be required in order for them to fully participate in public life

9. Claiming, implying or insinuating that trans people should not be able to participate in sports
as the gender they know themselves to be, due to a perceived advantage, only due to birth
assignment not matching gender identity
